Terms and conditions and complaints

1. Introductory provisions
These terms and conditions govern the rights and obligations between the Operator and the Customer when making a reservation, purchasing a gift voucher and using the Smash Car experience activity.
The Smash Car service is understood to be an adrenaline-fueled experience activity consisting of the demolition of a vehicle intended for ecological disposal, in a controlled area and under specified safety conditions.
2. Service reservation
The Smash Car service can be booked via the online booking system on the Operator's website.
The reservation is valid upon confirmation and payment of the required amount, if advance payment is specified for the given date or service.
After completing the reservation, the Customer will receive a confirmation to the e-mail address provided when ordering.
The Customer is obliged to provide true and complete information when booking.
3. Price and payment terms
The price of one Smash Car activity is 8,490 CZK and includes:
* 1 real car intended for demolition,
* activity duration of 60 minutes,
* entrance for up to 7 people,
* protective equipment,
* smashing equipment,
* 1 water per person.
When booking online, the customer pays a deposit of 2,000 CZK.
The remaining part of the price, i.e. 6,490 CZK, is required to be paid on site before the start of the activity, in cash or by card.
In addition to the package, it is possible to purchase the participation of additional people, at a price of 800 CZK for each additional person, if operational, capacity and safety conditions allow.
4. Change or cancellation of reservation
The customer can change or cancel the reservation free of charge no later than 72 hours before the scheduled date, using the button provided in the confirmation email.
If the customer cancels the reservation in time, the amount already paid will be refunded in the same way as it was received.
In the event of cancellation of the reservation less than 72 hours before the date or in the event that the customer or participants do not show up for the reserved date, the amount paid will be forfeited in full.
The operator reserves the right to change, move or cancel the reservation, in particular for operational, security, technical or organizational reasons. In such a case, the customer will be offered an alternative date or a gift voucher.
5. Entry and conditions of participation
Smash Car is a physically and mentally intensive activity. The participant may participate only if his/her health allows it.
Entry to the activity area is permitted only to persons who meet the operator's conditions, in particular age, health and safety requirements.
If the participant is under 18 years of age, his/her participation is only possible under the conditions set by the operator, in particular when accompanied by a legal guardian or with his/her prior written consent.
Each participant is required to complete a briefing and familiarize themselves with the rules of safe movement and behavior in the area before entering.
Entry to the demolition zone is permitted only with the assigned protective equipment, signing a liability paper and after the consent of the operator.
The participant is required to follow the operator's instructions, behave responsibly and not move outside the designated area.
6. Safety rules
Entry into the area is not permitted to persons under the influence of alcohol, narcotics or psychotropic substances, nor to persons whose participation the operator reasonably assesses could endanger the safety of themselves, other participants or the operator.
The operator is entitled to not allow a customer or participant into the area without a refund or part thereof or to exclude them from the activity if they violate the safety rules, disobey the operator's instructions or otherwise endanger safety.
Each participant confirms that they have read the rules before starting the activity and enters the area at their own risk to the extent permitted by applicable law.
7. Liability for damage and injury
The participant is liable for damage caused outside the designated area or by violating the operator's instructions or safety rules.
The operator is not liable for damage, loss or injury resulting from failure to obey the operator's instructions, irresponsible behavior or violation of the established rules by the participant.
The operator is not liable for any items left behind, lost or damaged by visitors unless they have been taken into custody.
This does not affect the consumer's rights arising from generally binding legal regulations.
8. Ecological approach
Before the vehicle is included in the activity, operating fluids and other defective or dangerous components are removed by a professionally authorized company.
The vehicles used in the Smash Car project are not newly scrapped solely because of this activity, but would have been destined for dismantling and subsequent ecological disposal even without it. The Smash Car activity therefore does not represent a separate ecological burden, but only an intermediate step before the final processing of the vehicle.
All waste generated is sorted after the activity and sent for further processing in accordance with applicable legal regulations.
9. Gift vouchers
A gift voucher for the Smash Car service can be purchased through the reservation system or in another manner specified by the operator.
A gift voucher is issued for 1 Smash Car activity, i.e. for 1 car / 60 minutes / up to 7 people, unless otherwise stated on the voucher.
The validity of the gift voucher is 6 months from the date of purchase, unless otherwise stated.
After purchase, the voucher is sent electronically, usually in PDF format, to the customer's e-mail.
The gift voucher can only be used during its validity period. After the expiration of the validity period, the unspent voucher is forfeited without compensation.
The gift voucher is non-refundable and cannot be exchanged for cash, unless otherwise stipulated by law.
10. Withdrawal from the contract
In accordance with Section 1837 letter a of the Civil Code j) of Act No. 89/2012 Coll., the Civil Code, the consumer does not have the right to withdraw from a contract concluded at a distance, if it concerns a contract for the use of leisure time and the performance is provided on a specified date or period.
This does not affect the customer's right to cancel the reservation under the conditions specified in Article 4 of these Terms and Conditions.
11. Complaints about services
The customer - consumer has the right to file a complaint if the service was not provided in the agreed scope, quality or time.
The complaint can be filed electronically at the e-mail address: info@smashcar.cz
When filing a complaint, it is appropriate to state in particular:
* identification of the reservation or order,
* description of the alleged defect,
* requested method of handling the complaint,
* customer contact details.
The operator will issue the customer with a confirmation of the complaint.
The complaint will be resolved without undue delay, no later than 30 days from the date of its submission, unless the parties agree otherwise.
The customer will be informed about the method of handling the complaint via the contact details provided.
12. Personal data protection
Personal data of customers and visitors are processed in accordance with applicable legal regulations, in particular the GDPR regulation and related legal regulations of the Czech Republic.

13. Out-of-court settlement of consumer disputes
In the event of a consumer dispute, the consumer has the right to contact the entity for out-of-court settlement of consumer disputes.

14. Final provisions
These terms and conditions govern the relationship between the operator and the customer when making a reservation, purchasing a voucher and using the Smash Car service.
The operator reserves the right to change or supplement these terms and conditions accordingly. The wording of the terms and conditions effective at the time of making a reservation or order is always binding for the customer.
By sending a reservation, purchasing a gift voucher or participating in an activity, the customer confirms that he has read and agrees to these terms and conditions.
These terms and conditions come into effect on 1.5.2026.
